Because it is a generalization and does not accurately represent what a laser scanner does. In perfect and un-realistic conditions, then yes it is possible, there are no perfect conditions.
3D objects are different in size, colour, distance, temperature, shape, reflectivity. A laser scanner is a constant and will be affected by all these things.
It is better to say that 2mm is acheivable in a certain benchmark/calibration situation. Or that it is an average sum of all the errors. Given that it is an average then the accuracy for any given point could would have a lesser chance of being 2mm.

Of course you are right:
Accuracy is heavily depending on the reflectance of the scanned objects (that´s by far the largest portion of influence).
That´s why all vendors specify the accuracy under certain circumstances. Typically 10% or 90% reflectance are used.
This is mostly not to limit repsonsibility but rather to have any chance at all to give a specification. The actual results are always depending on the specific situation and can by principle not be standardized.
